Mercury™ Service Agreement

Thank you for choosing Intertech Private Cable. Inc.'s ("Intertech" or "Intertech's") Residential Internet Access Service ("Mercury" or "Mercury Service"). As a precondition to provision of Mercury Service, you agree to the following terms and conditions. You further agree that these terms and conditions may be amended by Intertech at any time at its sole discretion. Should Intertech choose to amend this Residential Customer Service Agreement ("Agreement"), it may do so by notifying you, at Intertech's choice, in writing, or by electronic mail ("Email") to the account you establish with Intertech as a part of your service, or by posting on Intertech's web site.
Computer and Installation
You agree to provide a properly operating computer, hardware and software necessary to access the Internet through our service. You represent that prior to our installation you have made back up copies of any files contained on your computer and you agree to maintain regular backups while subscribing to Mercury Service. Should the installation require that Intertech open your computer for the installation of any hardware, Intertech accepts no responsibility for the proper functioning of your Computer or any information that may be lost or must be restored from backup as a result of a malfunction.
You agree and understand by receiving Mercury Service you will be accessing an unsecured network, and that you do not have the right or expectation of security to be provided by Intertech or others. You agree that accept responsibility for the security of your computer and for any viruses, worms, denial of service attacks, etc. to which you may be subjected or which may be launched against others from your computer, with or without your knowledge.
Mercury Service
The Mercury Service you will be provided with consists of a connection to the network of networks commonly referred to as the Internet, including access to electronic mail and the World Wide Web. This access is provided AS IS. You agree that Intertech does not control the Internet, and accepts no responsibility for content to which you may be exposed or for which you may be unable to access. Although you will be continuously connected to our service, we make no claim as to the availability of our service at any particular time. To the extent that you may require access to the Internet at all times for any purpose including but not limited to bidding, trading of stocks or securities or any other purpose which may be time sensitive, you agree to maintain an additional means to access the Internet besides Mercury Service at all times.
