Mercury Service is solely intended for the private residential use of our subscribers and may not be resold or transferred. In the event that Intertech discovers you are re-selling or transferring its Mercury service you agree to make immediate payment to Intertech for the greater of the payments you received or the value of the service sold or transferred at Intertech's then-current rates, retroactive to the date you first subscribed to Mercury Service. This remedy is in addition to and not to the exclusion of any other remedies Intertech may have at law or in equity.
You agree that you must share the resources of Mercury Service with all other Mercury subscribers. You agree that Intertech may restrict or otherwise throttle bandwidth to ensure that other users are able to utilize Mercury Service.
You agree you are prohibited from sending Email to anyone who does not previously agree to receive Email from you, downloading/uploading child pornography, attempting to harm the security of the Mercury network or any other network to which you may attempt to access through Mercury Service, or otherwise using Mercury Service to do anything illegal. You agree hat these terms and conditions of the Mercury Acceptable Use Policy may be amended by Intertech at any time at its sole discretion. Should Intertech choose to amend this Mercury Acceptable Use Policy, it may do so by notifying you, at Intertech's choice, in writing, or by Email to the account you establish with Intertech as a part of your service, or by posting on Intertech's web site at intertechcable.com.
You further agree not to engage in any use or activity which would be a violation of the acceptable use policies of Intertech's Internet Service Providers. Information on the use policies of Intertech's providers may be obtained upon written request from Intertech and may also (at Intertech's option) be posted at intertechcable.com.
